Refund & Cancellation Policy

This policy explains your rights regarding cancellations and refunds for the BreathFree2 “Quit Smoking in 21 Days” Service, operated by BreathFree2 BV, Test Street 2, 1010 TT Amsterdam, the Netherlands. Contact us at info@rolandb31.com with any questions.

Your statutory rights under Dutch and EU consumer law (including Directive 2011/83/EU as implemented in the Dutch Civil Code) are not affected by anything in this policy.

1. Your 14-Day Cooling-Off Right (Legal Withdrawal Right)

Under EU distance-selling law, you have a 14-day right of withdrawal starting from the date you purchase access to the Service, with no need to give a reason.

Important exception for digital content:

At checkout, we will ask whether you wish to access the programme immediately (before the 14-day cooling-off period expires). If you:

confirm that you want immediate access, and
acknowledge that doing so means you waive your statutory right of withdrawal once the content is made available to you,

then the cooling-off right is lost from the moment the digital programme is unlocked for you. This is in accordance with Article 16(m) of Directive 2011/83/EU.

If you do not request early access, you may withdraw within 14 days of purchase and receive a full refund.

How to exercise your withdrawal right:

Contact us within 14 days at info@rolandb31.com with a clear statement that you wish to withdraw. We will process your refund within 14 calendar days using your original payment method.

2. Cancellation of Recurring Subscriptions

2.1 How to Cancel

You can cancel a recurring subscription at any time by:

Visiting your account settings in the BreathFree2 app and selecting “Cancel Subscription”, or
Emailing us at info@rolandb31.com with your registered email address and a request to cancel.

We will confirm your cancellation by email within 2 business days.

2.2 When Cancellation Takes Effect

Cancellation takes effect at the end of the current paid billing period. You will continue to have full access to the Service until that date. We do not charge a cancellation fee.

2.3 Auto-Renewal Reminder

We will send you a reminder email at least 14 days before your subscription automatically renews, including the renewal price and a link to cancel. This is in line with the Dutch consumer rules on automatic renewal of contracts.

3. Refund Eligibility After the Cooling-Off Period

Outside of the statutory 14-day withdrawal right (or where that right has been waived), the following applies:

Partially used billing periods: We do not provide pro-rata refunds for the remainder of a billing period once a subscription payment has been charged. You retain access until the end of the paid period.
Annual or multi-month prepaid plans: If you cancel a prepaid plan early (after the cooling-off period and after immediate access has been granted), we are not obliged to refund the unused portion. However, we will consider refund requests made within 30 days of the start of a new annual billing period on a goodwill basis, minus any pro-rata amount for time used.
Technical failures caused by us: If the Service is unavailable or materially defective for more than 72 consecutive hours due to issues on our side, you may be entitled to a pro-rata credit or partial refund for the affected period. Please contact us at info@rolandb31.com.

4. Non-Refundable Situations

Refunds will generally not be issued in the following circumstances:

You changed your mind after waiving the cooling-off right and using the Service.
You failed to cancel before an auto-renewal date despite receiving our advance reminder.
You did not achieve your personal quit-smoking goal (the Service is a self-help tool and outcomes depend on individual commitment and circumstances).
Your account was terminated due to a breach of our Terms & Conditions.

5. Promotional & Discounted Purchases

Purchases made at a promotional or discounted price are subject to the same refund policy. Any refund issued will be for the amount actually paid, not the standard list price.

6. How Refunds Are Processed

Approved refunds are returned to your original payment method within 14 calendar days of approval. Processing times may vary depending on your bank or card issuer. We will confirm your refund by email.

7. Disputes

If you are unhappy with our handling of a refund request, please email info@rolandb31.com. If we cannot resolve the matter within 30 days, you may:

Submit a complaint to the Geschillencommissie (Dutch Disputes Committee) if applicable to our sector;
Contact the Dutch Consumer Authority (Autoriteit Consument & Markt, ACM) at www.acm.nl;
Use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
