These Terms & Conditions (“Terms”) govern your use of the BreathFree2 digital wellness application and the “Quit Smoking in 21 Days” subscription programme (collectively, the “Service”), operated by BreathFree2 BV, Test Street 2, 1010 TT Amsterdam, the Netherlands (“we”, “us”, “our”). By creating an account or purchasing a subscription you agree to these Terms. If you do not agree, do not use the Service.

BreathFree2 provides a digitally delivered, 21-day structured programme designed to help users quit smoking. The programme is delivered via our app and/or web platform and may include guided exercises, AI-powered coaching, educational content, progress tracking, and support materials.
The Service is a wellness and self-help tool only. It is not a medical device, medical treatment, or substitute for professional medical advice. Always consult a qualified healthcare professional for medical concerns.
We offer subscription plans as described at the point of purchase (e.g. monthly, quarterly, or one-time 21-day programme access). The exact price, billing cycle, and included features are shown before you confirm payment.
Where you purchase a recurring subscription, it will automatically renew at the end of each billing period at the then-current price unless you cancel before the renewal date. You will receive a renewal reminder by email at least 14 days before the renewal date, in accordance with Dutch consumer law (Burgerlijk Wetboek, Book 6).
We will notify you of any price changes at least 30 days in advance. If you do not accept a price change, you may cancel before it takes effect.
Payments are processed by third-party payment processors (see Section 10). By providing payment details you authorise us to charge your chosen payment method. All amounts are stated in euros (EUR) and are inclusive of any applicable VAT.
Under Dutch and European Union distance-selling law (Directive 2011/83/EU, implemented in the Netherlands via the Burgerlijk Wetboek), you have a 14-day right of withdrawal from the date of purchase, without giving any reason.
However, if you expressly request that we begin delivering the digital content immediately (which we will ask you to confirm at checkout), and you acknowledge that this means you waive your right of withdrawal once delivery has commenced, then the cooling-off right will be lost once the Service has been made available to you.
If you have not requested early access, you may exercise your withdrawal right by contacting us within 14 days at info@rolandb31.com or by using any unambiguous written statement. We will refund your payment within 14 days of receiving your withdrawal notice, using the same payment method unless otherwise agreed.
You may cancel a recurring subscription at any time via your in-app account settings or by emailing info@rolandb31.com. Cancellation takes effect at the end of the current billing period; you retain access until that date. See our Refund & Cancellation Policy for details on refund eligibility after the cooling-off period.
We may suspend or terminate your account if you breach these Terms, engage in fraudulent activity, or if we are required to do so by law. We will give you reasonable notice where possible. If we terminate for reasons unrelated to your conduct, we will refund a pro-rata portion of any prepaid subscription fees.
All content, software, trademarks, and materials within the Service are owned by or licensed to BreathFree2 BV. You receive a limited, non-exclusive, non-transferable licence to access and use the Service for personal purposes. You may not copy, distribute, modify, or reverse-engineer any part of the Service.

The Service is provided “as is”. We do not guarantee that you will successfully quit smoking. To the fullest extent permitted by Dutch law:
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under mandatory Dutch law.
These Terms are governed by Dutch law. If a dispute arises, we encourage you to contact us first at info@rolandb31.com so we can try to resolve it informally. If we cannot resolve it within 30 days, disputes may be submitted to the competent court in Amsterdam, or to an alternative dispute resolution body such as the Geschillencommissie where applicable. As an EU consumer you may also use the European Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
We may update these Terms from time to time. We will notify you by email or in-app notification at least 14 days before material changes take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
